A three-judge bench headed by Justice L Nageswara Rao and comprising of Krishna Murari and S Ravindra Bhat while hearing a the petitions asking for quota for OBC candidates observed that right to reservation is not a fundamental right.
A plea was submitted by different political parties over the Centre’s decision to not provide a 50 percent reservation to OBCs in NEET medical college seats in Tamil Nadu.
The bench stated that nobody can claim their right to reservation as a fundamental right, and hence not giving quota benefits cannot be construed as a violation of so.
The bench asked the lawyers to approach the Madras High Court with their pleas, instead.
