The bar council of Maharashtra and Goa in a letter opposed to the idea of decriminalization of section 138 of Negotiable Instrument Act, it stated that such actions are against the judicial pronouncement and will have cascading effects on life of people.   

The letter was addressed to the finance ministry; the council further clarified if the move is enforced by the government it will adversely affect the livelihood of practicing advocates and “their survival will be put to great stake.” 

The Negotiable instrument act provides safeguard to bona fide defaulters; therein the court stated that it will be just and reasonable to not decriminalize the provisions of Negotiable instruments act rather make it more stringent and deterrent.
