ALLAHABAD HC DIRECTS THE STATE TO PROVIDE DETAILS OF MEMBERS OF TABILIGHI JAMAT WHO ARE LODGED IN QUARANTINE CENTRES OR ARE RELEASED

The Allahabad HC directs the Uttar Pradesh government to apprise the status regarding the Tabilighi Jamat members who were quarantined after their arrival to the State.

These members reached Uttar Pradesh from various parts of the country as well as the world. They were quarantined during the initial stages of the Coronavirus virus outbreak since there was a nationwide lockdown. 

The petition was filed by Shaad Anwar through PIL and pointed out that the members of Tablighi Jamaat have completed their prescribed quarantine period by the Government. The petition also contends that the members are now quarantined for no just or valid reason and it is violating their right to life guaranteed by the Constitution of India since the Government is not releasing them.

Responding to these allegations, the respondent counsel contended that some of the members are quarantined on their own since there is non-availability of transportation from the State to where they belong. The facts however have been disputed by the petitioner and the Court has directed the State to provide details regarding the lodged members of Tablighi Jamaat. The Court pointed out that, 

“Having considered all facts of the case, we deem it appropriate to direct the State to make available all details about the members of Tablighi Jamat, who were quarantined, released after completing the quarantine period or have yet not been released despite completing the tenure of quarantine.”
